Introduction

Welcome to FieldWork.

These Terms & Conditions ("Terms") govern your use of the FieldWork website and your engagement with FieldWork for consultancy, website development, software development, AI integration, maintenance and related services.

By accessing this website, submitting an enquiry, booking a discovery call, or engaging FieldWork for services, you acknowledge that you have read and understood these Terms and agree to be bound by them.

For the purposes of these Terms, "FieldWork", "we", "us" or "our" refers to FieldWork, operating from Jalukbari, Guwahati, Assam – 781013, India.

"Client", "you" or "your" refers to the person, company, organisation or other entity engaging FieldWork.

1. Our Services

FieldWork provides digital design and engineering services, which may include:

  • Website consultancy, audits, strategy and roadmaps
  • Website design and development
  • Full-stack application development
  • SaaS, dashboards and digital platforms
  • AI-powered applications and integrations
  • Automation, voice interfaces and chatbots
  • Website maintenance and ongoing improvements
  • Other digital services agreed in writing between FieldWork and the Client

Our services and capabilities may evolve over time.

2. Discovery and Project Scope

Projects generally begin with a discovery call or written brief.

Before development begins, FieldWork will provide a project proposal, quotation, statement of work or equivalent written document setting out the applicable scope, deliverables, timeline, fees, payment schedule, assumptions, Client responsibilities and third-party dependencies, where applicable.

Our standard process is Discover → Design → Build → Launch → Grow. Typical timelines are approximately 2–4 weeks for websites and 6–12 weeks for applications, depending on scope and dependencies.

3. Engagement Models

Depending on the project, FieldWork may work under one of the following models:

Fixed Scope — A defined project with agreed deliverables and an agreed price.

Sprint-Based — Work delivered in defined development sprints, with priorities reviewed every sprint.

Retainer — Ongoing monthly capacity for improvements, development, maintenance or other agreed services.

The applicable engagement model will be specified in the relevant proposal or agreement.

4. Fees and Payment

Fees will be communicated to the Client in the applicable proposal or quotation.

Unless otherwise agreed in writing:

  • Work will commence after the required advance payment has been received.
  • Payments must be made according to the agreed payment schedule.
  • Third-party costs, including domain registration, hosting, software licences, paid APIs, subscriptions, payment gateways or other external services, may be charged separately unless expressly included in the project quotation.
  • Applicable taxes and statutory charges will be charged where applicable.

FieldWork may pause work where an undisputed payment remains overdue.

5. Scope Changes

The project fee and timeline are based on the agreed scope.

Requests that materially change the agreed scope may require a change request, revised quotation or additional fee.

Examples include new pages or features, new integrations, significant design changes after approval, additional functionality, changes to previously approved requirements, and additional revision rounds beyond those included in the agreed scope.

FieldWork will communicate material scope changes and their impact before proceeding wherever reasonably practicable.

6. Client Responsibilities

The Client agrees to provide information, content, assets, approvals, credentials and other materials reasonably required for the project.

This may include brand assets, text and copy, images and media, product/service information, domain or hosting access, third-party account access, API credentials, legal or regulatory content required for the Client's website/application, and timely feedback and approvals.

Delays in receiving required materials or approvals may affect the project timeline.

7. Design Reviews and Approvals

FieldWork may provide design previews, prototypes, working demos or development builds during a project.

Our standard process is intended to provide visible progress through working demos rather than presenting the entire project only at the end.

Once a design, feature or deliverable has been approved, subsequent material changes may be treated as a scope change.

8. Project Delays

FieldWork will make reasonable efforts to meet the agreed timeline.

However, timelines may change because of delayed Client feedback, delayed content or assets, third-party service issues, changes in scope, API or platform changes, hosting or infrastructure issues outside FieldWork's reasonable control, or events beyond reasonable control.

Where a delay occurs, FieldWork will communicate the relevant impact as reasonably practicable.

9. Ownership and Intellectual Property

Subject to full payment of the applicable project fees, the Client will own the project-specific deliverables created specifically for the Client, including applicable website code, application code, project content, design assets created specifically for the Client, and project-specific accounts.

FieldWork retains ownership of its pre-existing tools, libraries, templates, frameworks, processes, know-how, reusable components and internal systems unless specifically assigned to the Client in writing.

Ownership and use of third-party software, open-source libraries, frameworks, fonts, stock assets, APIs, plugins, infrastructure and other materials remain subject to their respective licences and terms.

10. Third-Party Services

Projects may depend on third-party services such as hosting providers, domain registrars, cloud platforms, payment gateways, analytics platforms, authentication providers, AI providers, communication platforms, APIs and software libraries.

FieldWork does not control third-party services and cannot guarantee their uninterrupted availability, pricing, policies or continued functionality.

The Client may be required to maintain its own accounts and subscriptions with such providers.

11. AI-Powered Services

Where a project incorporates artificial intelligence, FieldWork may use third-party AI models, APIs or infrastructure.

AI-generated outputs may contain inaccuracies, omissions or unexpected results.

The Client is responsible for reviewing AI-generated outputs before relying on them for legal, financial, medical, regulatory or other consequential purposes.

The specific AI services and data-processing arrangements applicable to a project may be described in the relevant project agreement.

12. Quality and Performance

FieldWork aims to build projects with performance, accessibility and testing considered as part of the development process.

For projects where these standards are included in the agreed scope, FieldWork may target:

  • Maximum Largest Contentful Paint of approximately 2.0 seconds
  • Lighthouse score of 95+
  • WCAG 2.2 AA accessibility

These are project targets rather than unconditional guarantees, as real-world performance can depend on hosting, content, third-party services, network conditions and other factors outside FieldWork's control.

13. Warranties and Support

FieldWork will use reasonable skill and care in providing the agreed services.

Unless expressly stated otherwise in writing, FieldWork does not guarantee a particular business result, a particular number of visitors, leads, customers or sales, search-engine rankings, third-party platform availability, continuous or uninterrupted operation, or that a website will be completely free from defects.

Any post-launch support, maintenance or warranty period will be governed by the applicable project agreement.

14. Confidentiality

Each party agrees to keep confidential information received from the other party confidential and to use it only for purposes related to the engagement.

This does not apply to information that is publicly available without breach of an obligation, was already lawfully known, is independently developed, or is required to be disclosed by law or lawful authority.

15. Client Content and Rights

The Client represents that it has the necessary rights and permissions to provide content, images, logos, data, software, documents and other materials supplied to FieldWork.

The Client remains responsible for ensuring that its content does not infringe third-party rights or applicable laws.

FieldWork may refuse to use materials where it reasonably believes doing so could create legal, security or ethical concerns.

16. Website and Service Availability

FieldWork may temporarily suspend access to its website or services for maintenance, security updates, infrastructure changes or technical issues.

We will make reasonable efforts to minimise disruption.

17. Limitation of Liability

To the maximum extent permitted by applicable law, FieldWork will not be liable for indirect, incidental, consequential or special losses, including loss of profits, revenue, business opportunities, data or goodwill arising from the use of our website or services.

FieldWork's aggregate liability arising from a particular project will, to the extent permitted by applicable law, be limited to the fees actually paid by the Client to FieldWork for that project during the applicable engagement period.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

18. Termination

Either party may terminate a project in accordance with the termination provisions of the applicable project agreement.

If a project is terminated, the Client remains responsible for fees for work completed up to the effective termination date and approved non-refundable third-party costs remain payable.

Work product will be delivered according to the applicable payment and handover terms. Confidentiality and intellectual-property provisions intended to survive termination will continue to apply.

19. Force Majeure

Neither party will be responsible for failure or delay caused by circumstances reasonably beyond its control, including major infrastructure failures, natural disasters, war, government action, widespread service outages or similar events.

20. Changes to These Terms

FieldWork may update these Terms from time to time.

The updated version will be published on this website with a revised "Last Updated" date.

For existing projects, the terms contained in the applicable project agreement will generally govern that engagement.

21. Governing Law

These Terms shall be governed by the laws of India.

The courts having jurisdiction over Guwahati, Assam shall have jurisdiction, subject to applicable law.
